The product must be exactly the same?

Yes, we will price match or refund the price differences on a "Like-for-Like" basis on the same product brand & model including prevailing tax (GST), manufacturer's warranty and same payment method as well as mode of delivery. Do note that some of our competitors will sell "export set" which do not come with local warranty or charge you extra for using your credit card.

Who are considered your competitors?

All local retail competitors who are authorised by the vendor to sell a new, factory-sealed product with a local warranty including their online prices. We will also price match products sold by major online retailers.

How do I request a price match or refund price difference from a COURTS store?


Customers can go to any stores or call our Customer Service Hotline 03-3000 8998 within 10-30 days (depending on the type of products) from date of purchase. Please show us the lower price that is still in effect that you want Courts to price match.

How do I show "proof" of price?


The best way to show proof of price is to bring in a picture of competitor’s price tag, competitor’s advertisement and catalogue to facilitate the price match. Courts will then review and verify the price match request, in some situation we will call up the competitors to confirm the price.

How long do I have to wait to get a refund?


If you visit any of our physical stores with the necessary “proof” as above, we will process the claim within 7 working days and give you the refund in the form of Courts Cash Vouchers. If you call our Customer Service hotline, we may need more time to verify the claim before we get back to you.

What if the competitor does not have the item in stock or has limited quantities of the product?


Sometimes a listed competitor will advertise for a product with very limited quantities for a special price or the item may even be out of stock, in these scenarios, the item will not be eligible for price matching or refund the price difference.

Does COURTS price match "free gift with purchase" offers?


No. COURTS does not price match "free gift with purchase" offers as they are not exactly "like for like".

Does COURTS price match offers with financing?


No. Courts also does not price match to competitor’s price that can only be received when using the competitor’s credit card or any other financing offers.

Does COURTS match competitors' trade-in value and offers on trade-in products?


No. Courts does not match competitors’ trade-in value and offers on trade-in products.

How will the difference in price be refunded to me?


The difference will be paid in the form of Courts Cash Vouchers.

What are the exclusions?

  • The online or in-store prices of retailers not listed above.
  • Mobile phones with contract.
  • Products sold by marketplace sellers.
  • Any financing offers, bundle offers, free gifts, pricing errors, coupon offers, items that are advertised as limited quantity, trade-in offers, out of stock items, refurbished / used items, special hour sale event items, credit card offers and rent / lease programs.
  • Each item is only entitled to price match or refund the price difference once.
  • Refund the price difference is for items that have been fully paid, for item that has not been fully paidwe will do at least a price match.

What do I do if I want to exchange or get a full refund for an item I bought at your stores?

If you are not happy with the product you purchased at our physical store, just bring it back to any of our store within 30 days for an exchange or refund. Do kindly bring back the sealed item along with the original receipt, warranty card, free gifts, vouchers, accessories, associated with the purchase in its original condition (sealed box).

What if I have opened the box or unsealed the item?

We will still exchange or make a full refund within 14 days of the purchase with the complete original packaging, original receipt, warranty card, free gifts, vouchers, accessories associated with the purchase in its good condition. Check in-store for more details.

When returning software, ink cartridges, batteries, tablets, mobile phones, game consoles, they must be in sealed and original condition to be eligible for a refund or exchange.

How will my money be refunded to me?

The refund will be given in the same mode of payment that was used in the original purchase. If delivery has taken place, then the refund will exclude delivery charges paid. For payment made with credit card, bank may take 4 to 6 weeks to process the refund.

What if the product is found damaged upon opening the brand new box?

We will replace the product for you if we find such cases we define as “Dead on Arrival or in short DOA” within 14 days of the purchase date. After 14 days, we will repair the item for you.

What are the exclusions?

  • Display set items sold as seen.
  • Apple branded products like ipad/iphone. (Apple computer is eligible for refund/exchange).
  • Made-to-order and personalised orders made especially for you are not exchangeable / refundable. (Items where a customer has requested specific attributes (e.g. finish, colour, size) or where we build upon your order).
  • Assembled furniture and air-conditioners (once installed).
  • Home appliances (once used), mattresses, personal care products, beauty & body products, apparels & accessories, health & fitness products, headsets and earphones due to hygiene reasons.
  • For headsets and earphones, you will need to send the product back to the manufacturer authorized office for exchange.

How does the 5-Hour works?

If you buy an available stock item before 1pm, we will deliver by 6pm. Or if you buy before 4pm, you will received the item by 10pm. Customers or representative must be at home to receive the delivery during the window time. Arrival time excludes assembly/set-up time.

Can I cancel or made changes to same day delivery?

In order to get your order to you speedily, it will be hard to cancel this after we send our truck out. Hence we are not able to call back the truck. If you really need to change or cancel the truck, another delivery arrangement with another delivery fee will have to be chargeable.

Extended Warranty – Electrical

SERVICE CONTRACT
STANDARD TERMS & CONDITIONS GOVERNING COURTS’ EXTENDED WARRANTY SERVICE CONTRACT FOR ELECTRICAL & I.T. PRODUCTS

You have selected the duration of the Contract you require for the product purchased by you (“Product”) on the sales receipt/invoice concerned and agree to be bound by the terms and conditions governing the Contract as set out herein.

The Product must be purchased new from Courts (as defined below) and if not purchased simultaneously with the Product, the Contract relating to the Product must be purchased by you within 30 days from the delivery date of the Product. The duration of the Contract is between 2 to 5 years commencing from the purchase date or delivery date of your Product (whichever is later) and expires on the relevant anniversary of the selected period chosen.

PRODUCT ELIGIBILITY
The Contract only covers a Product which:
(i) is purchased new from Courts.
(ii) is manufactured for use in Malaysia.
(iii) has, at the time of purchase, the manufacturer’s complete and original warranty that is valid in Malaysia.
(iv) in the case of consumer Products such as electronics and major appliances, is or has been limited to domestic and personal use. Office Products such as facsimile machines, copiers and computers are covered for small office/home office use only.

DEFINITIONS:
In this Contract, the following words have the following meanings:
(i) “we,” “us” and “our” or “Courts” refer to COURTS (MALAYSIA) SDN BHD (Co No. 198601005660) (154820-D)
(ii) “you” and “your” refer to the Customer or Purchaser and if applicable, the Co-Purchaser of the Product covered by the Contract.
(iii) “Coverage” means coverage for mechanical and electrical defects in the Product including where applicable, the Rechargeable Battery attached to such Product and with additional benefits such as International Coverage (defined below), Accidental Damage (defined below), Power Surge Protection (defined below) and Food Spoilage Protection (defined below).

COVERAGE:
Product - The repair service coverage is for mechanical and electrical defects in the Product purchased by you under this Contract. If it is too costly or we are unable to repair your Product, we have the option to replace your Product with another of like kind, quality and specifications less allowance for deterioration and depreciation due to market value at our discretion. Due to technological advances, the replaced product may be of a lower retail value than the faulty Product. Replacement parts may be new, original or non-original manufacturer’s parts that conform to factory specifications and shall be determined at our discretion. If the Product is replaced, the replaced Product will continue to be covered under the Contract on the same terms until the expiry of the Contract. The faulty Product replaced becomes the property of Courts.

Rechargeable Battery attached to Product - The repair service coverage is for mechanical and electrical defects in the Rechargeable Battery attached to the Product purchased by you under this Contract. If it is too costly or we are unable to repair the Rechargeable Battery, we will replace (one time only) the original battery attached to the Product purchased by you if the Rechargeable Battery cannot be charged under all circumstances. This repair service coverage is for 1 year from the purchase date or delivery date of your Product (whichever is later).

This repair service coverage for Rechargeable Battery attached to the Product applies only to repairs and replacements done in Malaysia.

Additional Benefits - Under the master insurance policy issued by AIG Malaysia Insurance Berhad (“AIG”), which Courts has taken for the benefit of its customers who have purchased a Product under the Contract, you are entitled to the following:-
International Coverage for Product (excluding Rechargeable Battery attached) - This coverage is for mechanical and electrical defects, to be serviced at a manufacturer or authorised service centre outside of Malaysia. You are required to provide details of your new address if you have relocated to a foreign country. Neither we nor our insurer, AIG shall bear any responsibility if the manufacturer of your Product does not provide any service or support at the new geographic location. Subject to the aforesaid requirement, you may contact the nearest manufacturer or authorised service center for repairs. If the cost estimate of the requisite repair exceeds 65% of the purchase price of the Product or, if the manufacturer or authorised service centre determines that a replacement is necessary, you must call the Courts Cover Extended Warranty HotLine or e-mail us at warranty@courts.com.my to obtain further instructions and authorisation for repair or replacement prior to undertaking any repair or replacement. We have the sole discretion to determine if the Product should be repaired or replaced. You must also contact Courts Cover Extended Warranty Hotline or e-mail us at warranty@courts.com.my to arrange for the submission, within 60 days of the repair or replacement, the original repair or replacement invoice and/or job sheet that includes a statement of the problem, the service performed and a breakdown of the repair cost with a copy of the sales receipt / invoice. An approved claim will be reimbursed to you in Malaysian currency at the applicable exchange rate prevailing at the time of the claim.

If you are permanently residing in Malaysia, you are only entitled to a one-time only repair or replacement of the Product under the International Coverage. If you have relocated to a destination outside Malaysia or, do not permanently reside in Malaysia, you may, under the International Coverage, repair the Product up to the limit of the purchase price paid for the Product (the “Limit”) until the Limit is exhausted or the Product is replaced, whichever is earlier.

The International coverage will be effective from the purchase date or delivery date (whichever is later) until the earlier of
(i) the Limit is exhausted,
(ii) the Product is replaced, or
(iii) the expiry of the Contract.

*Food Spoilage Protection - if food items are spoilt due to a faulty refrigerator covered under the Contract, you will be reimbursed for such food spoilage up to a total of RM200 per incident provided that we have been notified of the food spoilage within 2 working days of the incident and the same has been verified and inspected by our authorised repairer and properly documented.

*Accidental Damage & Power Surge Protection - This repair service coverage is for: (i) Mechanical or electrical defects of the Product caused by accidental damage due to physical impact (such as cracked screen) and spillage of liquids (collectively referred to as “Accidental Damage”); and
(ii) Mechanical or electrical defects of the Product caused by power surge (“Power Surge Protection”). For such loss, AIG may join with any other insurance company in repairing, reinstating or replacing the Product that is damaged where the Product is insured elsewhere. In cases where the Product is replaced with another of like kind, quality and specifications, the replacement may be a different model; be made by a different manufacturer; not include the identical features and functions as the Product covered under the Contract. You are only entitled to make a one-time claim from AIG for repair services under Accidental Damage and Power Surge Protection respectively. Accidental Damage does not cover damage due to negligence, omission or default. Accidental Damage and Power Surge Protection will be effective from the purchase date or delivery date (whichever is later) until the earlier of (i) the one-time claim, or (ii) the expiry of 2 years from such purchase date or delivery date, as the case may be. Claims in relation to Accidental Damage and Power Surge Protection must be made in writing and submitted to us within 7 working days of the incident.

EXCLUSION & LIMITATION OF LIABILITY:
The terms and conditions of the master insurance policy shall form an integral part of this Contract and you are required to comply with the same in order to enjoy the benefits. Details of such terms and conditions are available for your study before your purchase of this Contract and a copy of such terms and conditions will be furnished to you on request. The master insurance policy does not cover the following acts, circumstance or event:
a) losses that do not occur within the period of insurance;
b) losses caused by illegal acts committed by you;
c) losses that are intentionally caused by you;
d) losses due to war (whether war has been declared or not), civil commotion, uprising, martial law, riot or the act of any lawfully constituted authority;
e) losses due to the order of any government, public authority or customs’ officials;
f) an act in contravention of a government prohibition or regulation or law;
g) invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power;
h) an act of terrorism.

Our and AIG’s liability will not, under any circumstances, extend to any loss or injury to a person or loss or damage to property or any incidental, contingent, special or any direct or indirect loss and consequential damages including but not limited to losses incurred due to any delay in rendering any services related to this Contract and/or loss of use during the period that your Product is at an authorised repairer and/or while awaiting replacement parts.

Neither Courts nor AIG will be liable under the Contract if you do not submit the Product to an authorized repairer for repair before (a) the expiry of the Contract or (b) if a breakdown report has been submitted before the expiry of the Contract, within 30 days of its breakdown.

EXCLUSIONS FROM COVERAGE:

  • Products that are still covered by the manufacturer’s original written warranty, repairer’s warranty, or any other warranty in effect.
  • Problems or defects not covered under the original manufacturer’s primary written warranty.
  • Any defects that are subject to the manufacturer’s recall.
  • Your failure to comply with the manufacturer’s recommendations to you on routine maintenance, inspection, cleaning, lubrication, external adjustments or alignments and any other instructions.
  • Non-operating and cosmetic items, paint, color, or Product finish; accessories used in or with the Product; cables, cords, cartridges and stylus, tapes or software (including software bundled with a personal computer); add-on options incorporated in a Product for which options are not essential to the basic function of the Product.
  • Unauthorised modifications made to the Product and/or problems/defects arising from such unauthorized modifications; altered serial numbers; failure to follow manufacturers’ instructions on installation, operation or maintenance; repairs performed by non-authorised repairer; any items not affecting the function of the Product; image burn.
  • Software (including operating system and any stored data), defects resulting directly from software installation and or removal, computer virus, virus prevention, and other peripherals.
  • Repairs to hardware that has been added after the original purchase of the Product.
  • Consumables such as vacuum cleaner belts, toner, print or ink cartridges, bulbs, compact discs, digital tapes, etc.
  • Batteries, internal or external to the Product that are not original equipment manufacturer (“OEM”) regardless whether such batteries are rechargeable or not, and non-rechargeable OEM batteries.
  • External faults such as wiring, electrical connection or plumbing, piping, trunking, fitting, realigning of signal receivers (poor reception), and consequential loss of any kind.
  • Repairs necessitated by intentional physical damage or damage by water submersion.
  • Failure caused by a voltage converter, power outages or surges (unless covered under the Power Surge Protection), inadequate or improper voltage or current.
  • Cost of diagnosis where no defect has been found or noted.
  • On-site service charges.
  • Shipping charges and damage, express service charges, transportation damage, removal, installation or reinstallation of the Product unless specifically mentioned in the Contract, products on loan during the repair process.
  • Commercial use (multi-user organisations), public rental, use for profit or communal use for multi-family housing.
  • Any loss or damage to the Product resulting from fire or flood, howsoever caused.
  • Any loss or damage to the Product resulting from an act of God (including without limitation, events such as earthquake), war, invasion, act of foreign enemy, hostilities or warlike operations, civil war, civil commotion.
  • Any liability arising out of implied warranties of merchantability, implied warranties of fitness, and strict liability.
  • Any loss or damage to the Product due to negligence of any kind.
  • Any loss or damage caused by accident, neglect, animal and insect and/or organic infestation (from internal and/or external sources), abuse, misuse, burglary, theft, sand, water damage, corrosion, battery leakage, acts of god, commercial usage (except for office products such as facsimile machines, copiers, scanners, printers and computers),
  • Reception and transmission problems resulting from external causes.
  • Any failure, malfunction, defect, inoperability, breakdown, disruption, or stoppage of the product or any product, functions or the functions of any related to, directly or indirectly any design, planning or engineering incompatibility, omission or deficiency with the incidence of the year 2000.
  • Use of the service in any illicit trade or transportation or in the commission of a felony.
  • Any liabilities arising from the Product or the use of it.
  • Any acts of fraud, or other dishonest or criminal acts.

When the Product failure occurs due to an electrical or mechanical defect, you must call the Courts Cover Extended Warranty Hotline at 1800 18 1108 to report the failure during office hours. Our Customer Service Representatives will be ready to guide you through the service process. To expedite service, please ensure that you have your Contract details readily available before placing the call. If the failure is not reported to us prior to repair, the repair will not be approved. If the original manufacturer’s warranty is still valid, you are required to utilise the original manufacturer’s warranty notwithstanding that the Contract is already in force.

Repairs must only be carried out by a repairer nominated by us on each occasion and is subject to pre-authorisation from us. During the duration of the Contract, portable items should be brought to our nominated repairer. All other items will be subject to call-out service. For all repairs, the Contract sales receipt/invoice for the Product must be presented.

Termination of Contract
The Contract will terminate if any of the following events occur:-
(i) upon expiry of the Contract;
(ii) if your Product is surrendered to Courts; or
(iii) upon your written notification to us of cancellation of the Contract together with surrender to us of the original sales receipt/invoice within 30 days of the date of purchase of the Contract.

Courts retain the right to terminate the Contract if any installment payment under the Credit Sale Agreement for the Product remains unpaid for a period of 3 months and all fees paid to Courts in relation to this Contract shall be non-refundable and shall be forfeited absolutely.

Service Contract
The Contract is a service contract for repair services. The Contract is not an insurance policy or guarantee given by Courts relating to the nature of the material, workmanship or performance of the Product save for the Additional Benefits wherein a master insurance policy has been issued by AIG in favour of Courts for the benefit of its customers who have purchased a Product under the Contract.

Assignment of Contract
If you sell or transfer your Product to another consumer within the period of the Contract, you must call the Courts Cover Extended Warranty Hotline within 14 days and effect the transfer of the Contract in writing. It is also important to report your new address if you move and take the Product with you. You may only transfer this Contract if you have purchased the Product by cash or if you have fully settled and discharged all your obligations and liabilities under the Credit Sale Agreement relating to the Product.

Personal Data Protection
This Contract is subject to terms and conditions set out below. Kindly take a few moments to check that all the particulars, specifically your personal information printed in this Contract are correct. Failure to revert within 14 days from the date of this Contract will mean that all your personal information contained herein are complete, true and accurate. Any personal information collected by and retained by us is for the purpose of fulfilling Our obligations under this Contract as well as to update you on any of our related services. Kindly be informed that in order to fulfill our obligations under this Contract, we will provide your personal information to AIG, which in turn may be disclosed by AIG to individuals, service providers & organizations associated with AIG or any other selected 3rd parties (within or outside of Malaysia, including reinsurance & claims investigation companies & industry associations) for the purpose of storing and processing this application and providing subsequent service(s) for this purpose, AIG’s financial products and services and data matching, surveys and to communicate with you for such purposes and in order to support back-end processing and services associated with this Contract. You understand that you have the right to obtain access to and to request correction of any personal information held by us and/or AIG concerning yourself. Such request can be made by contacting us as stated above. By submitting your personal information, you are indicating your consent to allow us and/or AIG or any other selected third parties to keep you posted on any other products, services and upcoming events. If you do not wish to be contacted by us or AIG, you can opt out anytime by writing to us or AIG, as the case may be.

Notwithstanding that this Contract may be reproduced in several languages, the English version shall prevail.

I hereby having read and understood the terms and conditions, agree to be bound by the same.

NOTE: Signature(s) of Purchaser/Co-Purchaser are not required if you are signing a Services Agreement with Courts.

Extended Warranty – Furniture

SERVICE CONTRACT
STANDARD TERMS & CONDITIONS GOVERNING COURTS’ EXTENDED WARRANTY SERVICE CONTRACT (“CONTRACT”) FOR FURNITURE PRODUCTS

This Contract is not an Insurance Policy or Guarantee. This Contract is an extension of the dealer’s warranty as may be applicable. It is not a guarantee or promise relating to the nature of the material, workmanship or performance of your Product.
You have indicated you require the Contract for the furniture you have purchased (the “Product”) from Courts on the sales receipt/tax invoice and you have agreed to be bound by the terms and conditions governing this Contract.
The Product must be purchased new from Courts and if not purchased simultaneously with the Product, the Contract must be purchased by you within 30 days from delivery date of the Product.
The term of your Contract will be 3 years from the purchase or delivery date (whichever is later) (i.e. 2 years extension plus the one (1) year manufacturer/dealer’s warranty period or Courts’ original written warranty period).

DEFINITIONS:
In this Contract, the following words have the following meanings:
(i) “we,” “us” and “our” or “Courts” refer to COURTS (MALAYSIA) SDN BHD (Co No. 198601005660) (154820-D)
(ii) “you” and “your” refer to the Customer or Purchaser and if applicable, the Co-Purchaser of the Product covered by the Contract.

IMPORTANT INFORMATION:
The repairs/replacements covered by this Contract for your Product are set out below:

BASIC COVERAGE: This Contract covers Structural Damage. “Structural Damage” refers to:
(1) damage to frames caused by warp and breakage;
(2) bending and breakage of metal components;
(3) separation of seams; ie the breakage of threads that hold the seams together, with the thread holes still intact without any material tearing;
(4) damage to mechanical or electrical mechanism; (5) broken zips, castors and buttons;
(6) lifting or peeling of the genuine external leather finishing – separation of leather from the fabric lining.
It is Courts’ discretion on whether to repair or replace your Product with a like kind or quality as Courts deems appropriate in the circumstances. Replacement parts will be original or non-original manufacturer’s parts that perform to factory specifications. If the Product is replaced, the remaining tenure together with the terms and conditions of your Contract will continue for the replaced Product.

DUTY OF CARE:
Courts have no obligations or liability whatsoever under the Contract if the manufacturer’s recommended instructions on the care and cleaning of the Product, its structure and upholstery are not complied with by you. The Product should be cleaned, vacuumed and rotated regularly and kept away from direct sun exposure.

LIMITATION OF LIABILITY:
Courts shall not be liable for any direct or indirect loss or injury to a person or loss or damage to property, whether it be incidental, contingent, special, or conse- quential including but not limited to losses due to any delay in rendering services or loss of use of the Product for the period that your Product is at an authorized repairer and/or awaiting replacement parts.

Courts liability for any one (1) repair visit shall in no event exceed the market value of the Product at the time of the said repair.

Courts will replace your Product with one of like kind and quality if the Product is not repairable or beyond economical repair. The replaced Product (the spoilt unit) shall become the property of Courts. Courts reserves the right to refund to you the market value or original purchase price of the spoilt Product, whichever is lower, if Courts is unable to provide a replacement product that matches the quality and specification of the faulty Product. If the Product is replaced, the replaced Product will continue to be covered under the Contract on the same terms until the expiry of the Contract.

The total costs paid or payable under this Contract for any one (1) repair visit or replacement shall not exceed the original purchase price (or such proportion thereof as may be determined by Courts in its sole discretion to be attributable to the spoilt unit) paid by you for the Product covered by this Contract.

Courts will not be liable under the Contract if you do not submit the Product to an authorized repairer for repair before (a) the expiry of the Contract or (b) if a breakdown report has been submitted before the expiry of the Contract, within 30 days of its breakdown.

EXCLUSIONS:

  • Products that are still covered by the manufacturer’s/dealer’s original written warranty, or Courts’ dealer warranty, repairer’s warranty, or any other warranties in effect.
  • Any defects that are subject to recall by the manufacturer/dealer.
  • Normal wear and tear of the Product (unless otherwise covered by the relevant warranty cover).
  • Failure to follow manufacturer’s recommended instructions for routine care maintenance, inspection, cleaning, removal of odors, lubrication, external adjustments etc.
  • Unauthorized modifications or add on options made to the Product.
  • Non-operating and cosmetic items, paint, color, or Product finish; accessories used in or with the Product; external cables and cords; glass and lens; add-on options incorporated.
  • Failure to follow manufacturer’s installation, operation or maintenance instructions.
  • Repairs performed by any non-authorized repairer.
  • External faults such as wiring or electrical connection and consequential losses of any kind.
  • Arm caps and scatter cushions.
  • Misplacement of buttons.
  • Repairs necessitated by accidental or intentional physical damage (such as chipping, denting, scratching).
  • Cracked glass due to omission, negligence or default.
  • Repairs to upholstery caused by burns and/or punctures if tears and/or rips caused by such burns and/or punctures are sighted/located on the same upholstery.
  • Burglary, theft, corrosion, insect and/organic infestation (from internal and/external sources), pet damage, misuse, neglect and abuse.
  • Damage resulting in any type of stains, general soiling from normal use, fabric failure including fraying, fading or use of non-colour fast materials.
  • Cost of diagnosis where no defect has been found or noted.
  • Defects and on-site service charges not covered by the manufacturer's/dealer’s original written warranty.
  • Shipping charges, express service charges, transportation damage, costs of removal, installation or reinstallation of the Product.
  • Commercial use (multi-user organizations), public rental, use for profit or communal use for multi-family housing.
  • Furniture in storage or transit.
  • Any loss or damage to the Product resulting from fire, smoke damage, ash, flood or sunlight (howsoever caused).
  • Any loss or damage to the Product resulting from an act of God (including without limitation, events such as earthquake), war, invasion, act of foreign enemy, hostilities or warlike operations, civil war, civil commotion.
  • Do-It-Yourself furniture or furniture that is assembled by you.
  • Damage caused by excessive heat.

If the Product failure occurs, you must call the Courts Cover Extended Warranty Hotline at 1800 18 1108 (during office hours) to report the failure during office hours. Courts’ Customer Service Representatives will guide you through the service process. To expedite service, please ensure that you have your Contract details readily available before placing the call. If the failure is not reported to Courts prior to repair, the repair will not be approved. You are required to utilize the original manufacturer’s/dealer’s warranty if it is still valid notwithstanding that the Contract is already in force.
Repairs must only be carried out by a repairer nominated by us on each occasion and is subject to pre-authorisation from us. During the duration of the Contract, portable items should be brought to our nominated repairer. All other items will be subject to call-out service. For all repairs, the Contract sales receipt/invoice for the Product must be presented.

Termination of Contract
The Contract will terminate if any of the following events occur:-
(i) upon expiry of the Contract;
(ii) if your Product is surrendered to Courts; or
(iii) upon your written notification to us of cancellation of the Contract together with surrender to us of the original sales receipt/invoice within 30 days of the date of purchase of the Contract.

Courts retain the right to terminate the Contract if any installment payment under the Credit Sale Agreement for the Product remains unpaid for a period of 3 months and all fees paid to Courts in relation to this Contract shall be non-refundable and shall be forfeited absolutely.

Assignment of Contract
If you sell or transfer your Product to another consumer within the period of the Contract, you must call the Courts Cover Extended Warranty Hotline within 14 days and effect the transfer of the Contract in writing. It is also important to report your new address if you move and take the Product with you. You may only transfer this Contract if you have purchased the Product by cash or if you have fully settled and discharged all your obligations and liabilities under the Credit Sale Agreement relating to the Product.

Personal Data Protection
This Contract is issued pursuant to your subscription to the Extended Warranty Service AND is subject to terms and conditions set out below. Kindly take a few moments to check that all the particulars, specifically your personal information printed in this Contract are correct. Failure to revert within 14 days from the date of this Contract will mean that all your personal information contained herein are complete, true and accurate. Any personal information collected by and retained by us is for the purpose of fulfilling our obligations under this Contract as well as to update you on any of our related services. Kindly be informed that in order to fulfill our obligations under this Contract, we will provide your personal information to AIG Malaysia Insurance Berhad (“AIG Malaysia”), which in turn may be disclosed by AIG Malaysia to individuals, service providers & organizations associated with AIG Malaysia or any other selected 3rd parties (within or outside of Malaysia, including reinsurance & claims investigation companies & industry associations) for the purpose of storing and processing this application and providing subsequent service(s) for this purpose, AIG Malaysia’s financial products and services and data matching, surveys and to communicate with you for such purposes and in order to support back-end processing and repair services associated with this Contract. You understand that you have the right to obtain access to and to request correction of any personal information held by Courts and/or AIG Malaysia concerning yourself. Such request can be made by contacting Courts as stated above. By submitting your personal information, you are indicating your consent to allow us and/or AIG Malaysia or any other selected third parties to keep you posted on any other products, services and upcoming events. If you do not wish to be contacted by us, you can opt out anytime by writing to us or AIG Malaysia, as the case may be.

Notwithstanding that this Contract may be reproduced in several languages, the English version shall prevail.

The Customer and if applicable, the Co-Purchaser hereby acknowledge and declare that they have read and understood the terms and conditions stated herein and agree to be bound by the same.

NOTE: Signature(s) of Purchaser/Co-Purchaser are not required if You are signing a Services Agreement with Courts.

Extended Warranty – IRP (Instant Replacement Plan)

STANDARD TERMS & CONDITIONS GOVERNING COURTS’ INSTANT REPLACEMENT PLAN SERVICE CONTRACT (“CONTRACT”) FOR ELECTRICAL & I.T. PRODUCTS

THE INSTANT REPLACEMENT PLAN SERVICE CONTRACT:
This Contract provides for the replacement of the product purchased by you (“Product”) if found to be defective during the term of one (1) or two (2) year(s) from expiry of manufacturer’s original written warranty, depending on the tenure of the Contract purchased by you. When the Product failure occurs due to an electrical or mechanical defect, you will receive a brand new replacement product of like kind, quality and value. Once the Product has been replaced, the Contract will automatically terminate.

The Product must be purchased new from Courts (as defined below) and if not purchased simultaneously with the Product, the Contract relating to the Product must be purchased by you within 30 days from the delivery date of the Product. The duration of the Contract is 1 or 2 years commencing from the purchase date or delivery date of your Product (whichever is later) and expires on the relevant anniversary of the selected period chosen.

PRODUCT ELIGIBILITY
The Contract only covers a Product which:
(i) is purchased new from Courts.
(ii) is manufactured for use in Malaysia.
(iii) has, at the time of purchase, the manufacturer’s complete and original warranty that is valid in Malaysia.
(iv) in the case of consumer Products such as electronics and major appliances, is or has been limited to domestic and personal use. Office Products such as facsimile machines, copiers and computers are covered for small office/home office use only.

DEFINITIONS:
In this Contract, the following words have the following meanings:
(i) “we,” “us” and “our” or “Courts” refer to COURTS (MALAYSIA) SDN BHD (Co No. 198601005660) (154820-D)
(ii) “you” and “your” refer to the Customer or Purchaser and if applicable, the Co-Purchaser of the Product covered by the Contract. (iii) “Coverage” means coverage for mechanical and electrical defects in the Product.

RECORD KEEPING:
In order to qualify for a Product replacement, you must present this Replacement Plan Service Contract (or where applicable, Courts’ Service Agreement evidencing your purchase of this Service Contract) and all original product receipts. Therefore, it’s important to place these documents in a safe place.

EXCLUSIONS FROM COVERAGE:

  • Products that are still covered by the manufacturer’s original written warranty, repairer’s warranty, or any other warranty in effect.
  • Problems or defects not covered under the original manufacturer’s primary written warranty.
  • Any defects that are subject to the manufacturer’s recall.
  • Your failure to comply with the manufacturer’s recommendations to you on routine maintenance, inspection, cleaning, lubrication, external adjustments or alignments and any other instructions.
  • Non-operating and cosmetic items, paint, color, or Product finish; accessories used in or with the Product; cables, cords, cartridges and stylus, tapes or software (including software bundled with a personal computer); add-on options incorporated in a Product for which options are not essential to the basic function of the Product.
  • Unauthorised modifications made to the Product and/or problems/defects arising from such unauthorized modifications; altered serial numbers; failure to follow manufacturers’ instructions on installation, operation or maintenance; repairs performed by non-authorised repairer; any items not affecting the function of the Product; image burn.
  • Software (including operating system and any stored data), defects resulting directly from software installation and or removal, computer virus, virus prevention, and other peripherals.
  • Repairs to hardware that has been added after the original purchase of the Product.
  • Consumables such as vacuum cleaner belts, toner, print or ink cartridges, bulbs, compact discs, digital tapes, etc.
  • Batteries, internal or external to the Product that are not original equipment manufacturer (“OEM”) regardless whether such batteries are rechargeable or not, and non-rechargeable OEM batteries.
  • External faults such as wiring, electrical connection or plumbing, piping, trunking, fitting, realigning of signal receivers (poor reception), and consequential loss of any kind.
  • Repairs necessitated by intentional physical damage or damage by water submersion.
  • Failure caused by a voltage converter, power outages or surges, inadequate or improper voltage or current.
  • Cost of diagnosis where no defect has been found or noted.
  • On-site service charges.
  • Shipping charges and damage, express service charges, transportation damage, removal, installation or reinstallation of the Product unless specifically mentioned in the Contract, products on loan during the repair process.
  • Commercial use (multi-user organisations), public rental, use for profit or communal use for multi-family housing.
  • Any loss or damage to the Product resulting from fire or flood, howsoever caused.
  • Any loss or damage to the Product resulting from an act of God (including without limitation, events such as earthquake), war, invasion, act of foreign enemy, hostilities or warlike operations, civil war, civil commotion.
  • Any liability arising out of implied warranties of merchantability, implied warranties of fitness, and strict liability.
  • Any loss or damage to the Product due to negligence of any kind.
  • Any loss or damage caused by accident, neglect, animal and insect and/or organic infestation (from internal and/or external sources), abuse, misuse, burglary, theft, sand, water damage, corrosion, battery leakage, acts of god, commercial usage (except for office products such as facsimile machines, copiers, scanners, printers and computers).
  • Reception and transmission problems resulting from external causes.
  • Any failure, malfunction, defect, inoperability, breakdown, disruption, or stoppage of the product or any product, functions or the functions of any related to, directly or indirectly any design, planning or engineering incompatibility, omission or deficiency with the incidence of the year 2000.
  • If Product is not submitted for replacement within thirty (30) days of its breakdown.
  • Use of the service in any illicit trade or transportation or in the commission of a felony.
  • Any liabilities arising from the Product or the use of it.
  • Any acts of fraud, or other dishonest or criminal acts.


LIABILITY: Your maximum entitlement shall in no event exceed the actual purchase price of the covered Product. You would be required to pay for the additional amount if the Replacement product value is more than the purchase price you paid for your original Product. We shall not in any event be liable to person or property for any incidental, contingent, special or consequential damages. This contract is non-transferable.

CANCELLATION: This Contract shall also be cancelled for any fraud or material misrepresentation, including but not limited to commercial or rental use and unauthorized repair of the covered Product.

During the duration of the Contract, portable items should be brought to our nominated retail outlet. All other items will be subject to call-out service. For the replacement, the Contract sales receipt/invoice for the Product must be presented.

Termination of Contract
The Contract will terminate if any of the following events occur:-
(i) upon expiry of the Contract;
(ii) if your Product is surrendered to Courts; or
(iii) upon your written notification to us of cancellation of the Contract together with surrender to us of the original sales receipt/invoice within 30 days of the date of purchase of the Contract.

Standard Terms & Conditions governing Courts’ Dr. Digital Health Plan Home Contract

You have indicated the contract (the "Contract") you require for the product purchased (the "Product") on the Courts Invoice and agree to be bound by the terms and conditions relevant to the Contract chosen as set out herein. The stated terms and conditions govern The Vendor's sales of service plan. The term of the Contract is one year from purchase date as set out in the Courts’ Invoice.

1) DEFINITIONS
For the purpose of these Terms and Conditions, the following definitions apply:
1.1) "Health Plan" refers to the service assurance plan chosen by The Client (defined below).
1.2) "Incident" refers to each occasion when The Vendor (defined below) provides On-Site (defined below) support to The Client (defined below) at the request of The Client.
1.3) "On-Site" refers to any location that is within Malaysia unless otherwise agreed to in writing by The Vendor.
1.4) "Software" refers to one or more programs, procedures, rules that are capable of operating on a Product (defined below).
1.5) "The Client" or “Purchaser” refers to the party who has purchased the Product for personal use and with whom the Health Plan is entered, with the address stated in the Courts Invoice.
1.6) "The Vendor" or “Courts” refers to COURTS (MALAYSIA) SDN BHD (Co No. 198601005660) (154820-D) a company incorporated in Malaysia, having its registered office at 23 Jalan Larkin, 80200 Johor Bahru, Johor, Malaysia.

2) SUPPORT COVERAGE
2.1) The Vendor shall provide the manpower and expertise, such as support specialist or service technician, to respond and if applicable, call at The Client's premises to verify the fault and attend to specific breakdown of the Product within the specified response time stipulated in the Health Plan. Support personnel are responsible to diagnose and troubleshoot software, hardware and network problems which only relate to the Product (each, a "Problem") except for proprietary products which can be serviced only by the manufacturer of such proprietary products or its authorized service agents.
2.2) The Vendor only warrants corrective support to resolve identifiable and reproducible Problems, and to help identify Problems that are difficult to reproduce.
The Client shall receive assistance in trouble-shooting Problems and setting configuration parameters. The cost of hardware replacement, if any, shall be borne by The Client. Should the cabling be faulty, The Client shall be responsible for the cost incurred in rectifying the faulty cable. The Vendor shall also not be liable for delays in performance or non-performance due to unforeseen circumstances or causes beyond its reasonable control.
2.3) Within Malaysia support services for products designated by The Vendor shall, where applicable, be performed at The Client's address (as noted in the Courts’ Invoice)
2.4) Support specialists shall provide free telephone consultation to The Client for up to 30 minutes maximum on the troubleshooting of Problems during Phone Support Hours (as defined in clause 3.1). In the event all Incidents (as described in clause 3.1) are utilized, the free telephone consultation shall be terminated.
2.5) In the event that the Product is not serviceable at The Client's address, The Vendor shall take back the Product for servicing at the service centre. .A loan unit, if available, will be provided at the sole discretion of The Vendor to the Client for the duration of the repair. The Client cannot claim such a loan unit as a matter of right.
2.6) For any Product that the Client has elected to self collect from the service centre such Product shall be kept for 3 months from the date on which The Client has been notified that the Product is ready for collection. Thereafter, the Product may be disposed according to The Vendor's policies. The Vendor shall not be liable or responsible to The Client for any losses or damage suffered by The Client as a result of such disposal of the Product.
2.7) The Product shall be in normal operating condition and updated with all the necessary software releases and updates issued to be eligible for support under this Contract. Work performed by The Vendor to meet these requirements is subjected to The Vendor's standard service rates.
2.8) The Client shall perform its backup of data prior to the repair, service or replacement of the hard disk drive. The Vendor shall not be responsible or liable in any manner whatsoever for any data loss, corruption, deletion and/or alteration of the data during the course of the service. The Client shall accept full responsibility for data and The Vendor shall not be required to advise or remind The Client of appropriate backup procedures.
2.9) Software reloading shall only be performed in the case of any problem with the system that is certified by The Vendor as necessitating such action.Any additional software installations shall be deemed as upgrading and hence shall be chargeable as per the standard service rates of The Vendor.
2.10) Support coverage shall be limited to Malaysia only.
2.11) Support coverage shall cease if The Client is in arrears of the Health Plan that was purchased from The Vendor on credit.

3.1.3) Support for Incidents for Products that are modems, routers and wireless routers is chargeable at 2 Incidents for every Incident attended to.
3.1.4) A minimum of 1 Incident shall be charged for every On-Site service rendered per Product.
3.2) Allocation of On-Site Incidents under any Health Plan is valid for a maximum of one (1) year from the date of commencement stated in the Courts Invoice. Phone support shall be terminated upon full utilization of On-Site Incidents. Any unused On-Site lncident(s) will be carried forward to a new Health Plan upon The Client's renewal Provided that such unused On-Site lncident(s) can only be carried forward for one renewed term.

4) FORCE MAJEURE
4.1) Neither party shall be liable for any failure to perform its obligations under the Contract if the failure results from events beyond the reasonable control of either party. For the purpose of the Contract, such events shall include, but not limited to, strikes, lock-outs, or other labor disputes, riots, civil disturbances, actions or inaction of government authorities, epidemics, wars, embargoes, acts of God or other catastrophes. In case of such events, the time for performance required by either party under the Contract shall be extended for any period during which the performance is prevented by the event. However, the other party may terminate the Contract by notice in writing if such event preventing performance continues for more than fourteen (14) days.

5) INTELLECTUALPROPERTY
5.1) Unless otherwise agreed in writing by both The Client and The Vendor, copyright materials (software and printed documentation) may not be copied except in accordance with the law.
5.2) The Client shall indemnify and hold harmless The Vendor, its employees, affiliates and its representatives from and against any liabilities, claims, demands, suits, judgments, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of the presence or use of any intellectual property right infringing material in connection with the Product by The Client.

6) CONFIDENTIALITY
6.1) Both parties agree to treat as confidential all information received from the other party has indicated in writing to be confidential except where such information (a) already exists in the public domain,(b) is independently developed by both parties outside the scope of the order, or (c) is rightfully obtained from third parties.
6.2) Both parties agree to disclose confidential information only to those of its employees and any third party who need to know it for the performance of the services under the Contract. Both parties shall ensure that such employees and the relevant third party are informed and agree to keep such information confidential.
6.3) This clause shall survive the termination of the Contract.

7) NON-SOLICITATION
7.1) The Client shall not directly or indirectly solicit for employment, employ or otherwise retain any of The Vendor's support specialists during the valid term of the Contract, notwithstanding that such support specialists may have resigned from his employment during the valid term of the Contract, unless agreed upon in writing by The Vendor.

8) TRANSPORTATION
8.1) The Client will have to pay a flat rate of Malaysia Ringgit Forty Nine (RM49-00) only per trip as transport charge for instances where The Client's hardware products and/or replacement parts thereof need to be carried to and/or returned from the authorized service centre of The Vendor. The Vendor reserves the sole and absolute right to revise the rate quoted herein at any time without notice or reference to The Client. However, should The Client arrange for self-carry this transport charge will not apply.

9) LIABILITY
9.1) Under no circumstances shall The Vendor be liable for any loss or injury to a person or loss or damage to property or any incidental, contingency, or any direct, indirect loss or consequential damages including but not limited to losses incurred due to any delay in rendering service under this Contract and loss of use during the period that the Product is under repair and/or while awaiting any hardware products or replacement parts.
9.2) None of the above Health Plans (that are governed by the terms and conditions of this Contract) should be construed as an insurance policy or a guarantee and is only a service contract. Each Health Plan (that is governed by the terms and conditions of this Contract) is not a guarantee or promise relating to the nature of the material, workmanship or performance of your Product covered by the Contract.

10) NON-TRANSFERABLE
10.1) Health Plan is intended for The Client's use only and is non-transferable. The Client shall promptly inform The Vendor of any change of address (mentioned in the Courts Tax Invoice) in the event The Client has shifted to a new address.

11) NO THIRD-PARTY RIGHTS
11.1) No person other than a party in this Contract may enforce this Contract.

12) DISPUTE RESOLUTION
12.1) This Contract and the Consent Form for Data Privacy shall be governed by, and construed in accordance with, the laws of Malaysia.
12.2) The parties irrevocably agree that the courts of Malaysia are to have exclusive jurisdiction to settle any disputes which may arise out of or in connection with this Contract or the Consent Form for Data Privacy.

Cleaning Service

STANDARD TERMS & CONDITIONS GOVERNING COURTS’ CLEANING SERVICES CONTRACT

DEFINITIONS:
In this contract, the following words have the following meanings:
(i) "we", "us" and "our" refer to Courts (Malaysia) Sdn .Bhd. (Co No. 198601005660) (154820-D)
(ii) "you" and "your" refer to the customer or purchaser of the Services (as defined below) from Courts (Malaysia) Sdn. Bhd.

You have purchased from us cleaning services (the "Services") for mattresses and/or sofas (the "Item(s)”) and have agreed to be bound by the terms and conditions relevant to the Services as set out herein.

You are entitled to :
(a) where you have purchased a package for the Services, the performance of the Services in Malaysia twice; or
(b) where you have purchased a single performance of the Services, the performance of the Services in Malaysia once only, in any case upon request to be made via telephone number 1300-221-123 (or such other number as may be notified to you from time to time) from Monday to Friday, 9.00am to 6.00pm.

The "Services" that you have purchased shall be utilized within two (2) years from date of purchase of the Services or delivery (if later) by us of the Item(s). If you do not request the performance of the Services during such period, your entitlement to the Services shall lapse and you shall not be entitled to any refund.

There is a possibility that the Services will not be able to remove all stains on the Item(s). We will use reasonable efforts to remove or lighten such stains but no warranty is given as to the effectiveness of the Services In removing stains.

Any feedback on the Services has to reach us within 24 hours after completion of the relevant performance of the Services, after which we will not be held liable and/or responsible.

We reserve the rights to refuse a request for the Service if the Item(s) are found (in our sole and absolute discretion) to be in an unfavourable or unsatisfactory condition, such as but not limited to (i) torn, worn out or aged fabric or upholstery or (ii) poor colour fastness. In the event of such refusal we shall refund to you a proportionate part of the price paid for the Services, and your entitlement to any Services not performed shall be cancelled accordingly.

Notwithstanding any other provisions of these Terms and Conditions, we will not be responsible for any damage or loss caused by:
(i) defects in the Item(s)' material or its colour fastness or
(ii) weakened fabric of the Item(s).

In the event of any loss or damage arising out of the Services, howsoever caused, for which we may accept liability, without prejudice, such liability shall be limited to the fair value of the Item(s) affected, after taking into consideration in value, due to age and usage, but shall not exceed FIVE times the price of the Services purchased in respect of that Item(s). For Item(s) not within our job scope, such liability shall not exceed a combined total of RM 3,000 in respect of such Item(s).

The damaged article will become our property once your claim is validated and full settlement by us of your claims is made.

This contract is not transferable by you. We may by one (1) month's prior written notice to you assign, transfer and novate any or all or our rights and obligations under this contract to any party.

A person who is not a party to this contract shall have no right to enforce any of its terms.

We reserve the right to amend these Term and Condition by notice and you hereby agree to all such amendments.
