Standard Terms & Conditions Governing COURTS' Cleaning Services Contract

Definitions:

In this contract, the following words have the following meanings:

  1. "we", "us" and "our" refer to COURTS (Malaysia) Sdn .Bhd. (154820-D)
  2. "you" and "your" refer to the customer or purchaser of the Services (as defined below) from COURTS (Malaysia) Sdn. Bhd.

You have purchased from us cleaning services (the "Services") for mattresses and/or sofas (the "Item(s)") and have agreed to be bound by the terms and conditions relevant to the Services as set out herein.

You are entitled to:

  1. where you have purchased a package for the Services, the performance of the Services in Malaysia twice; or
  2. where you have purchased a single performance of the Services, the performance of the Services in Malaysia once only,

in any case upon request to be made via telephone number 1300-221-123 (or such other number as may be notified to you from time to time) from Monday to Friday, 9.00am to 6.00pm.

The "Services" that you have purchased shall be utilized within two (2) years from date of purchase of the Services or delivery (if later) by us of the Item(s). If you do not request the performance of the Services during such period, your entitlement to the Services shall lapse and you shall not be entitled to any refund.

There is a possibility that the Services will not be able to remove all stains on the Item(s). We will use reasonable efforts to remove or lighten such stains but no warranty is given as to the effectiveness of the Services In removing stains.

Any feedback on the Services has to reach us within 24 hours after completion of the relevant performance of the Services, after which we will not be held liable and/or responsible.

We reserve the rights to refuse a request for the Service if the Item(s) are found (in our sole and absolute discretion) to be in an unfavourable or unsatisfactory condition, such as but not limited to (i) torn, worn out or aged fabric or upholstery or (ii) poor colour fastness. In the event of such refusal we shall refund to you a proportionate part of the price paid for the Services, and your entitlement to any Services not performed shall be cancelled accordingly.

Notwithstanding any other provisions of these Terms and Conditions, we will not be responsible for any damage or loss caused by:

  1. defects in the Item(s)' material or its colour fastness or
  2. weakened fabric of the Item(s).

In the event of any loss or damage arising out of the Services, howsoever caused, for which we may accept liability, without prejudice, such liability shall be limited to the fair value of the Item(s) affected, after taking into consideration in value, due to age and usage, but shall not exceed FIVE times the price of the Services purchased in respect of that Item(s). For Item(s) not within our job scope, such liability shall not exceed a combined total of RM 3,000 in respect of such Item(s).

The damaged article will become our property once your claim is validated and full settlement by us of your claims is made.

This contract is not transferable by you. We may by one (1) month's prior written notice to you assign, transfer and novate any or all or our rights and obligations under this contract to any party.

A person who is not a party to this contract shall have no right to enforce any of its terms.

We reserve the right to amend these Term and Condition by notice and you hereby agree to all such amendments.
