1. Apakah produk ini?

Produk ini menyediakan pampasan sekiranya berlaku sebarang kecederaan, hilang upaya atau kematian yang disebabkan oleh kejadian yang berlaku secara tiba-tiba, tidak dijangka dan secara kebetulan tanpa diduga.

2. Apakah konsep Syariah yang digunapakai?

Takaful: Suatu persepakatan yang berdasarkan konsep saling bantu membantu di mana para peserta takaful saling bersetuju untuk memberi caruman kepada satu dana yang sama untuk menyediakan manfaat kewangan bersama yang dibayar kepada peserta takaful atau waris-waris mereka apabila berlaku peristiwa yang telah dipersetujui.
Wakalah: Kontrak perwakilan di mana peserta melantik pengendali takaful untuk menguruskan caruman Takaful dengan mengenakan Yuran Wakalah untuk khidmat mereka.
Tabarru’: Ia adalah caruman daripada peserta kepada Akaun Pelaburan Risiko Am (GRIA) di mana Peserta bersetuju untuk melepaskan semua atau sebahagian daripada caruman tersebut untuk membayar manfaat-manfaat takaful.
Hibah: Adalah hadiah. Dalam Takaful, kontrak Hibah juga boleh diguna pakai dalam transaksi lain seperti perkongsian lebihan, di mana manfaat Takaful akan diberikan kepada penama berasaskan Hibah Bersyarat.
Ju’alah: Ia bermaksud komisen (ganjaran) bagi prestasi yang baik dalam menguruskan Akaun Pelaburan Risiko Am (GRIA) di mana pengendali takaful akan menerima insentif bersamaan dengan 50% daripada perkongsian Akaun Pelaburan Risiko Am (GRIA) pada akhir setiap tahun kewangan.
Qard: Pinjaman tanpa faedah yang disediakan oleh pengendali takaful jika berlakunya defisit Akaun Pelaburan Risiko Am (GRIA).

3. Apakah perlindungan / manfaat yang disediakan?

Nota:

Sila rujuk kepada kontrak sijil induk untuk keterangan penuh atas manfaat, terma dan syarat yang terdapat dalam produk ini.
Tempoh perlindungan adalah selama satu (1) bulan. Anda hendaklah memperbaharui perlindungan takaful anda setiap bulan.

4. Apakah terma dan syarat utama yang perlu saya berikan perhatian?

Kepentingan pendedahan - Anda mesti mendedahkan semua fakta penting seperti kegiatan peribadi anda termasuk jenis pekerjaan yang boleh mempengaruhi profil risiko dan bilangan sijil kemalangan peribadi yang anda sertai daripada pengendali takaful lain.
Kaedah Caruman - Caruman boleh dibuat melalui Courts Malaysia.
Kepentingan menyimpan resit - Adalah penting untuk menerima sesalinan resit daripada kami dan sila simpan resit ini sebagai bukti pembuatan caruman.
Kontrak Takaful Pengguna - Menurut Perenggan 5 Jadual 9 Akta Perkhidmatan Kewangan Islam 2013, jika anda memohon takaful ini sepenuhnya untuk tujuan yang tidak berkaitan perdagangan, perniagaan atau profesion anda, anda mempunyai kewajipan untuk mengambil langkah yang munasabah untuk tidak salah nyata dalam menjawab soalan-soalan di dalam Borang Cadangan (atau semasa anda memohon takaful ini)...
Kontrak Takaful Bukan Pengguna - Menurut Perenggan 4(1) Jadual 9 Akta Perkhidmatan Kewangan Islam 2013, jika anda memohon takaful ini untuk tujuan yang berkaitan dengan perdagangan, perniagaan atau profesion anda...
Prosedur Tuntutan - Anda perlu memberikan notis bertulis kepada kami dalam masa empat belas (14) hari selepas berlaku kejadian.
Kelayakan - Orang Yang Dilindungi mestilah ahli dengan Pemilik Sijil yang telah memenuhi kriteria untuk menyertai Group Personal Accident Takaful Scheme.

5. Apakah pengecualian utama di dalam produk ini?

Produk ini tidak melindungi tuntutan yang disebabkan oleh kejadian yang berikut:

Tempoh tangguh 7 hari dari tarikh permulaan untuk manfaat Pemulihan Denggi
Peperangan, Perang Saudara
Keadaan Sedia Ada
Bunuh Diri sama ada dalam keadaan siuman atau tidak siuman
Pembunuhan atau serangan Disebabkan Provokasi
Sebarang jenis perlumbaan selain daripada yang menggunakan kaki
Radiasi, Nuklear

6. Bolehkah saya membatalkan sijil ini?

Anda boleh membatalkan sijil anda dengan memberi notis bertulis kepada kami. Tidak akan ada pulangan balik caruman.

7. Apa yang perlu saya lakukan jika terdapat perubahan dalam butiran maklumat/peribadi saya?

Adalah penting bagi anda untuk memaklumkan kepada kami sebarang perubahan dalam butiran maklumat/peribadi termasuk penamaan, pekerjaan dan maklumat diri yang akan mempengaruhi profil risiko. Anda boleh menulis kepada kami menerusi alamat di bawah atau emel kepada kami di cservice@courts.com.my.

8. Jenis perlindungan Kemalangan Diri takaful lain yang disediakan:

ANDA DINASIHATKAN UNTUK MENGETAHUI SKALA MANFAAT BAGI KEMATIAN DAN HILANG UPAYA DI DALAM SIJIL INDUK TAKAFUL ANDA. ANDA BOLEH MENCALONKAN PENAMA DAN PASTIKAN PENAMA ANDA TAHU BERKENAAN SIJIL INDUK KEMALANGAN DIRI YANG ANDA SERTAI. ANDA PERLU MEMBACA DAN MEMAHAMI SIJIL INDUK TAKAFUL DAN BERBINCANG DENGAN EJEN ATAU HUBUNGI PENGENDALI TAKAFUL SECARA TERUS UNTUK MENDAPATKAN MAKLUMAT LANJUT.

Group Personal Accident Takaful Scheme — Product Disclosure Sheet

(Please read this Product Disclosure Sheet before you decide to participate in the Group Personal Accident Takaful Scheme. Be sure to also read the master certificate wording terms and conditions.)

1. What is this product about?

This product provides compensation in the event of bodily injuries, disablement or death caused solely and directly by a sudden, unforeseen and fortuitous event that happens unexpectedly.

2. What are the applicable Shariah concepts?

Takaful: An arrangement based on mutual assistance under which takaful participants agree to contribute to a common fund providing mutual financial benefits payable on pre-agreed events.
Wakalah: An agency contract where the participant appoints the takaful operator to manage contributions by charging an agreed Wakalah Fee for their services.
Tabarru': A contribution from participants to the General Risk Investment Account (GRIA); participants agree to relinquish all or a portion of their contribution to fund takaful benefits.
Hibah: A gift. In takaful, hibah is applicable to transactions such as surplus sharing; takaful benefits shall be given to the nominated recipient based on Conditional Hibah.
Ju’alah: A commission (reward) for performance in managing the GRIA; the takaful operator is entitled to an incentive equal to 50% of any surplus sharing from the GRIA after the end of each financial year.
Qard: An interest-free loan provided by the takaful operator in the event of a deficit in the GRIA.

3. What are the covers/benefits provided?

Duration of cover is for one (1) month. You need to renew your takaful cover monthly.

4. What are some of the key terms and conditions that I should be aware of?

Importance of disclosure — You must disclose all material facts such as your personal pursuits including your occupation which would affect the risk profile and number of personal accident certificates that you have participated from other takaful operators.
Contribution Method — Contribution to be made thru Courts Malaysia.
Importance of receipt keeping — It is important that you receive a copy of receipt from Us and please keep this receipt as proof of contribution made.
Consumer Takaful Contract — Pursuant to Paragraph 5 of Schedule 9 of the Islamic Financial Services Act 2013, if you are applying for this takaful wholly for purposes unrelated to your trade, business or profession, you have a duty to take reasonable care not to make a misrepresentation in answering the questions in the Proposal Form (or when you apply for this takaful). You must answer the questions fully and accurately. Failure to take reasonable care in answering the questions may result in avoidance of your contract of takaful, refusal or reduction of your claim(s), change of terms or termination of your contract of takaful. The above duty of disclosure shall continue until the time your contract of takaful is entered into, varied or renewed with us. In addition to answering the questions in the Proposal Form (or when you apply for this takaful), you are required to disclose any other matter that you know to be relevant to our decision in accepting the risks and determining the rates and terms to be applied. You also have a duty to tell us immediately if at any time after your contract of takaful has been entered into, varied or renewed with us any of the information given in the Proposal Form (or when you applied for this takaful) is inaccurate or has changed.
Non-Consumer Takaful Contract — Pursuant to Paragraph 4(1) of Schedule 9 of the Islamic Financial Services Act 2013, if you are applying for this takaful for a purpose related to your trade, business or profession, you have a duty to disclose any matter that you know to be relevant to our decision in accepting the risks and determining the rates and terms to be applied and any matter a reasonable person in the circumstances could be expected to know to be relevant, otherwise it may result in avoidance of your contract of takaful, refusal or reduction of your claim(s), change of terms or termination of your contract of takaful. The above duty of disclosure shall continue until the time your contract of takaful is entered into, varied or renewed with us. You also have a duty to tell us immediately if at any time after your contract of takaful has been entered into, varied or renewed with us any of the information given in the Proposal Form (or when you applied for this takaful) is inaccurate or has changed.
Claim Procedure — You must give written notice to us within fourteen (14) days after the occurrence of the incident.
Eligibility — Person Covered must be member with Certificate Holder who have fulfilled the criteria to participate in Group Personal Accident Takaful Scheme.

5. What are the major exclusions under this product?

This product does not cover claims caused by the following events:

Waiting period of the first 7 days from the effective date for benefit Dengue Recuperation
War, civil war.
Pre-existing condition.
Suicide while sane or insane.
Provoked murder or assault.
Any kind of racing other than on foot.
Radiation, nuclear.

6. Can I cancel my certificate?

You may cancel your certificate by giving written notice to us. There shall be no return of contribution.

7. What do I need to do if there are changes to my contact/ personal details?

It is important that you inform us of any change in your contact detail/life profile including nomination, occupation and personal pursuits which would affect your risk profile. You can write to us at the address below or email us at:

YOU ARE ADVISED TO TAKE NOTE OF THE SCALE OF BENEFITS FOR DEATH AND DISABLEMENT IN YOUR TAKAFUL MASTER CERTIFICATE. YOU MAY NOMINATE A NOMINEE AND ENSURE THAT YOUR NOMINEE IS AWARE OF THIS PERSONAL ACCIDENT MASTER CERTIFICATE THAT YOU HAVE PARTICIPATED. YOU SHOULD READ AND UNDERSTAND THE TAKAFUL MASTER CERTIFICATE AND DISCUSS WITH THE AGENT OR CONTACT THE TAKAFUL OPERATOR DIRECTLY FOR MORE INFORMATION.

Note: In the event of discrepancy, ambiguity and conflict in interpreting any term or condition, the English version shall prevail and supersede the Bahasa Malaysia version.
